Terms of Service

These terms cover your use of the PuffinCall app and this website. They are written to be read, not to be impressive. If something here seems unfair, email us and say so.

Note: this document is a starting draft. Have it reviewed by a Singapore-qualified lawyer before you rely on it, and fill in the bracketed details.


Who we are

PuffinCall is operated by Evma Pte. Ltd., a company registered in Singapore (UEN 202619401E). "We", "us" and "our" mean that company. "You" means the parent or guardian who creates the account.

Who may use PuffinCall

You must be at least 18 and the parent or legal guardian of the child who will use the app. By creating an account you confirm both, and you consent on your child's behalf to the collection described in our Privacy Policy.

You are responsible for who you add as a contact. We do not vet the people you approve, and we cannot — that judgement is yours.

Your account

Keep your sign-in details and your parent PIN to yourself. The PIN is what stands between your child and your settings and payments. It is stored only on your device, so we cannot reset it for you — see Support for what to do if you forget it.

You may delete your account at any time from the app's settings. It removes your family's data permanently, as set out in the Privacy Policy.

Minutes and plans

The free plan includes 20 minutes of talk time each month, shared between video and voice calls, which reset monthly. Plus includes 60 video minutes and 300 voice minutes each month; unused video minutes roll over up to a balance of 180 and unused voice minutes up to 900. Minutes bought as a top-up do not expire. Top-ups are available to Plus subscribers only.

A minute is a minute of conversation. Calls are rounded up to the next whole minute, and calls nobody answers are not charged. The family's balance covers calls in both directions.

Whether a call uses video or voice minutes is set per contact by the parent. A call placed in voice mode remains voice for its duration and cannot be changed to video once it has started.

We will not end a call in progress because a balance ran out. Your balance may go slightly negative and is corrected on your next top-up or renewal.

Payments, renewal and cancellation

All payments are handled by Google Play under Google's own terms. We never see your card details.

Plus renews automatically each month until you cancel. Cancel through the Play Store — Play Store → your profile picture → Payments and subscriptions → Subscriptions → PuffinCall → Cancel. You keep Plus until the end of the period you have paid for, then move to the free plan. Your contacts, photos and history are unaffected, and any pack minutes remain yours.

Refunds are governed by Google Play's refund policy. Beyond that, if something went wrong on our side, tell us — we would rather credit you than argue about it.

We may change prices. If we do, we will tell you in the app before the change affects you, and a price change never applies to a period you have already paid for.

Acceptable use

Do not:

  • Use PuffinCall to harass, frighten or harm anyone.
  • Add someone as a contact who has not agreed to be called.
  • Try to break, probe or work around the app's limits, or access another family's data.
  • Use the service to break any law that applies to you.

We may suspend or close an account that does these things. Where we can, we will tell you why first.

What we do not do

PuffinCall is not an emergency service. It cannot call the police, an ambulance, or any emergency number, and it should never be relied on in an emergency.

We do not record calls. Not for quality, not for safety, not for any reason. If you need a record of a conversation, this is not the app for it.

We do not guarantee a call will connect. Calls depend on both phones, both networks, and third parties we do not control.

Availability

We work hard to keep the service running, but we do not promise it will be available without interruption. We may need to take it down for maintenance, and things sometimes break.

We may change or discontinue features. If we discontinue the service altogether, we will give at least 30 days' notice in the app, refund any unused subscription period, and give you a way to delete your data.

Our liability

The service is provided "as is". To the extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential loss, or for missed calls, lost data, or a call that failed to connect.

Where we are liable, our total liability to you is limited to what you have paid us in the 12 months before the claim, or S$100, whichever is greater.

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud.

Changes to these terms

We may update these terms. If a change matters to you, we will tell you in the app before it takes effect. Continuing to use the app after that means you accept the new terms.

Law and disputes

These terms are governed by the laws of Singapore, and the courts of Singapore have jurisdiction. If you are a consumer somewhere else, this does not take away rights you have under your own country's law.
